On 16 April 2025, the UK Supreme Court delivered a thunderous ruling that the terms “man” and “woman” in the Equality Act 2010 refer to biological sex, not gender identity, not certificates, not feelings – but good old-fashioned chromosomes. The case, brought by the feminist campaign group For Women Scotland, challenged the Scottish Government’s attempt to treat anyone with a Gender Recognition Certificate (GRC) as legally male or female for the purposes of single-sex spaces, shortlists, and legal protections. In other words – a man who legally changed his gender would be treated as a woman under equality law. Not anymore. The Supreme Court’s decision means that in the eyes of the law, sex means biology. And when it comes to services or rights based on single-sex provision – such as women’s refuges, hospital wards, or sports categories – a GRC does not override your biological sex. For many, this isn’t discrimination – it’s realism. Campaigners argued that policies built on “self-ID” endangered women’s privacy, safety, and fairness. For the Scottish Government, it was about inclusivity and modern identity. But the court sided with the dictionary. It’s a victory that enraged trans rights activists and heartened radical feminists – the sort of political marriage rarely seen in daylight. What’s left now is the legal clean-up. Many government policies will have to be rewritten to reflect the court’s clarity. The ruling doesn’t abolish trans rights. But it sharply defines their legal limits.
